Sleeping Drunken Driver Awakens Spittin' Mad, Police Say
A Germantown man allegedly wasn't going to jail for his fifth OWI without a fight Saturday.
A 39-year-old Germantown man made a bad situation even worse after he attempted to use an officer as his personal spittoon.
Menomonee Falls police officers responded to a single car accident at 11:44 p.m. Saturday near Menomonee Avenue and Pilgrim Road. When officers arrived, they Seth Hofstad asleep behind the wheel of his vehicle that was still running. Officers smelled a strong odor of intoxicants, and the man had bloodshot eyes slurred speech, according to the report.
Hofstad wasn’t going to go to jail without a fight, however. He allegedly attempted to spit on an officer, which resulted in having a spit hood placed on his head. Hofstad also resisted officers and refused to take a field sobriety test, according to the report. A legal blood draw was forcibly taken later at Community Memorial Hospital. The police report doesn’t indicate what his blood-alcohol level was at the time.

The man was then booked and transported to jail, and his car was towed. He is currently facing charges for resisiting an officer, refusing to take a sobriety test, and his fifth-offense OWI.
