Speeding to Work Ends in Man's 5th OWI Arrest

Menomonee Falls man is accused of driving drunk after consuming whisky the evening before being pulled over by police, according to a criminal complaint.

A Menomonee Falls man is accused of felony drunken driving after he was caught speeding at Fond du Lac Avenue and Country Club Drive, according to a criminal complaint.

Daniel R. Roark, 45, was charged June 21 with operating while intoxicated-fifth offense. If convicted, he faces up to three years in prison and $10,000 in fines.

Roark was pulled over by a Menomonee Falls police officer at 5:39 a.m. June 20 after the officer spotted his vehicle traveling 45 mph in a 30 mph zone. Roark told the officer he was speeding to work because he was running late, according to a criminal complaint.

However, the officer noticed an odor of intoxicants coming from Roark. Roark, whose legal limit is .02 percent blood alcohol concentration because of his past convictions, failed parts of his sobriety test and had a preliminary breath test of .08 percent blood alcohol concentration, the complaint states.

Roark admitted to consuming whisky sours at 10 p.m. the evening before his arrest, the complaint states.

Roark previously was convicted of drunken driving in January 1989, August 1989, August 1991 and April 1999.
