Menomonee Falls Man Charged in Fox Point Burglary

Suspect broke into a Fox Point home and looked up pornography on the family computer early Saturday morning.

A 50-year-old Falls man is facing charges after he allegedly broke into a Fox Point home Saturday and began looking up pornography on a computer.

Otha L. Smith Jr. was charged in Milwaukee County Circuit Court Monday with one count of burglary and one count of possession of burglarious tools. If convicted, he faces up to 16 years in prison and $35,000 in fines.

According to the criminal complaint:

At 2:56 a.m. Saturday, a family living in the 7800 block of North Club Circle contacted after they were awoken by someone going through drawers in the downstairs portion of their house and they contacted police. When police arrived they found a patio door ajar.

A responding to the scene to assist, then spotted Smith walk towards a bicycle parked in the driveway of the home. The officer told him to stop, but Smith got on the bike and tried to flee through some bushes, but was caught and detained by police.

Smith had a Leatherman utility knife and two flashlights on him when arrested.

He told officers he met a man named “Rog” the night before and they agreed to burglarize a home. Initially Smith was supposed to be lookout while Rog burglarized the home, but he said Rog changed his mind and wanted Smith inside the home despite the fact he can’t run.

Smith told police Rog was “probably a half mile” away by the time he was arrested.

The day after the burglary, the owner of the home told police he discovered an iPad in the home had been opened and someone had gone onto the family computer and had looked up pornographic Websites.

Smith is currently being held in Milwaukee County Jail on $5,000 bail.
