A 46-year-old Menomonee Falls man is facing charges after he allegedly set up a crack deal for an undercover police officer and police informant, but ended up getting into a fight with the officer about another man’s drug debt.

Kris T. Borchardt was charged in Waukesha County Circuit Court Monday with one count of conspiracy to deliver cocaine, one count of maintaining a drug trafficking place and one count of theft. If convicted, he faces up to 14 years in prison and $45,000 in fines.

According to the criminal complaint:

On Feb. 17, 2011, the informant and the undercover officer met at Borchardt’s residence in the N8600 block of Dardis Drive after the suspect agreed to sell the two crack cocaine. While at the residence, Borchardt continued to question the undercover officer about how he knew the informant and asked if he was a police officer. Borchardt also mentioned he isn’t a drug dealer, but knows someone who can get it and he uses the deals as an opportunity to get some to smoke himself.

Borchadrt called his source and then he and his roommate went to look for police outside. After a while, he called the source back who said they would need to meet in Milwaukee instead.

The undercover officer said it was too much of a hassle to drive and wanted the $200 back he gave to Borchardt to pay for the drugs. However, Borchardt only gave back $150 and when the officer questioned him about this, he said the informant’s roommate owed him for drugs and he was taking the money from the officer.

The two then got into a shoving match, which eventually ended when the informant and officer left. While on their way out, Borchardt called them and said the crack would be there soon, but the officer said they were already halfway back to Waukesha.

Borchardt is currently out of custody and a warrant has been issued for his arrest.
